Trailhead Release Agreement                             Date _________________________

 

I, ______________________________ and Party, release My Chauffeur Transportation & Tour Co. of any responsibility to our group while our group is on any waterfalls trail hike or other trail hike in the Columbia River Gorge on _______________________, 2010.  I understand that we have hired My Chauffeur Transportation & Tour Co. to take us to any trailhead, and then to take us from any trailhead on our return from the hike in question to commence on the regular scheduled tour. We have hired My Chauffeur for this purpose and for this purpose only.  We have NOT hired My Chauffeur during the intervening time of the duration of the groups hike or individual hike commencing at any trailhead, and have released My Chauffeur Transportation Co. of any responsibility to the group during the above mentioned intervening hike time.  Furthermore, I or we understand that in wilderness areas, possible wilderness dangers are always present, and the hike is at our own risk, we will stay on the maintained trail. 

Notice is hereby given: Venturing off the maintained trail or overlooks and/or not paying attention to the trail or where you are hiking may result in injury or death.  Waterfall overlooks and bridges are extremely dangerous, especially for children, and one should turn back on the hike at the first sign of vertigo (frightened of heights) or nervousness.  We understand that My Chauffeur Co. is not responsible for any injuries sustained by any of our group members during any hike.  I understand that all children must be accompanied by their parent or legal guardian at all times.  The parent or legal guardian agrees to take full responsibility with regards to the safety of their children on this hike. 

In addition, our group understands that the Columbia River Gorge Highway is in the near vicinity of all of the waterfalls and stops on our tour.  We also understand therefore, that care should be taken, especially for children,  when near or crossing this highway to get to the viewing areas of the waterfalls, or at any other location on our tour.

We, individually and as a group, release My Chauffeur Company of any and all responsibility for any and all physical or emotional injuries from any hike and for crossing any road.

 

ALL PASSENGER’S MUST INITIAL THIS DOCUMENT THAT MY CHAUFFEUR HAS INSTRUCTED THEM THAT DUE TO THE NATURE OF ANY GORGE HIKE, THAT IT IS POTENTIALLY DANGEROUS, THAT EACH PASSENGER, WHETHER ADULT OR A CHILD, “HIKES AT THEIR OWN RISK”.  MY CHAUFFEUR WILL NOT BE RESPONSIBLE FOR ANY PASSENGER THAT INJURES HIS OR HERSELF IN ANY WAY WHILE HIKING OR DURING THE RENTAL PERIOD.  MY CHAUFFEUR WILL NOT BE RESPONSIBLE FOR INJURIES SUSTAINED TO ANY PASSENGER.

 

BY SIGNING BELOW, I RELEASE AND FOREVER DISCHARGE MY CHAUFFEUR COMPANY, AFFILIATES AND ADMINISTRATORS AND ASSIGNS FROM ALL MANNER OF ACTIONS, CAUSES OF ACTIONS, DEBTS, ACCOUNTS, BONDS, CONTRACTS, CLAIMS AND DEMANDS FOR OR BY REASON OF ANY DAMAGE, LOSS OR INJURY TO PERSON AND PROPERTY WHICH HAS BEEN OR MAY BE SUSTAINED AS A CONSEQUENCE OF THE FOLLOWING:

IN THE EVENT THAT ANY PART OF THIS CONTRACT IS DECLARED UNENFORCEABLE, THE REMAINING PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT. All adults must sign below regardless of whether they commence on the hike or not, otherwise the hike cannot commence. Parent or legal guardian must state their child's legal name below.
