(All Passengers’ Are Asked To Read and Agree By Signature Below)

I, the purchaser, agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”). I waive any and all claims I may have now and in the future, and release from all liability and agree not to sue My Chauffeur Transportation LLC., its officers, agents, representatives, employees or tour guides [hereafter referred to as “Staff”] for any personal injury, death, property damage, or loss sustained by me as a result of my participation in My Chauffeur Bus or Walking Tours due to any cause whatsoever, including without limitation, negligence on the part of My Chauffeur Transportation LLC., its Staff, tour partners, or other participants, or death or injury as a result of war, vehicles, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.
I am aware that the tour, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather or weather extremes subject to sudden and unexpected change. I accept all the inherent risks of the proposed bus or walking tour and the possibility of personal injury, death or property damage or loss resulting there from. I acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness My Chauffeur Transportation LLC. or its Staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety.
I understand that photographs taken on this tour may only be used for non-commercial or personal purposes.
Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the bus or walking tour.
In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by My Chauffeur Transportation LLC. or its Staff or any other inducement or coercion to go on the bus or walking tour. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this bus or walking tour and Wavier and Release prior to signing it and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators and successors.
I agree to grant the sponsors of this tour to a worldwide, royalty-free license to use my photographic, video, or digital likeness solely for promotional, educational, and/or commercial purposes.
As a participant on the tour, I accept full responsibility for my behavior, well being, and health throughout the tour, which may involve a variety of activities, unfamiliar locations, and modes of travel, including but not limited to: climbing stairs. I further realize that the tour may involve walking through unfamiliar, narrow and/or steep corridors, gangways, roads, crosswalks, stairways and driveways.
By purchasing the ticket(s), I affirm that I have fully understood and agree to these Terms and Conditions, Waiver and Release of Liability.
UNIVERSAL TERMS OF SERVICE:

· No Smoking Please – Smoking of any kind is prohibited within the vehicle. Fines apply.
· Seat belts must be worn at all times, by law.
· Drink alcohol moderately and responsibly – All ‘Hard Alcohol’ (16% ABV or higher) is PROHIBITED inside our vehicles due to over consumption/inebriation. Beer (6.4% or lower) or wine (14.9% or lower) are allowed but STRONGLY DISCOURAGED inside our vehicles due to over consumption. (Exception: Beer & Distillery Tour w/product purchased in route). Beer (6.5% ABV or higher) or wine (15% ABV or higher) are PROHIBITED. ALL ALCOHOL IS PROHIBITED IF NOT ALL PARTICIPANT’S ARE AGE 21 or over. Your Reservation Will End If Hard Alcohol Is Found. My Chauffeur is released & forever discharged from all responsibility related to damages, legal damages and/or injuries or death during and after this reservation caused from drinking alcohol.
All sickness, cleaning, and damage fees, will be paid for immediately, and with no notice, by charging your reservation agreement. A final price audit will be done after the conclusion (within 7 days) of your reservation.

Trailhead Release Agreement - Hiking is a potentially dangerous activity and can potentially result in injury or death. The hike descriptions contained in the TourPortland.com website are a community resource intended to help plan outings, but individuals using this resource are wholly responsible for anticipating potential hazards and evaluating their physical ability to follow a particular hike description. Use the links on this website and other websites to research trail and weather conditions, and always carry the Ten Essentials and know about extended hike/wintertime clothing. My Chauffeur and it's contributors are not responsible for the hikers who use this resource.
Therefore, I, and Party, release My Chauffeur Transportation & Tour Co. of any responsibility to our group while our group is on any Columbia R Gorge, Mt. Hood or Oregon coast hike or other trail hike, or chairlift, on the SCHEDULED TRIP DATE. I understand that we have hired My Chauffeur Transportation & Tour Co. to take us to any trailhead, and then to take us from any trailhead on our return from the hike in question to commence on the regular scheduled tour. We have hired My Chauffeur for this purpose and for this purpose only. We have NOT hired My Chauffeur during the intervening time of the duration of the groups hike or individual hike commencing at any trailhead, and have released My Chauffeur Transportation Co. of any responsibility to the group during the above mentioned intervening hike time. ALL HIKES ARE SOLO 'SELF-SERVICE' HIKES; your driver and/or tour guide WILL NOT/SHOULD NOT be accompanying you on your hike. If your driver/guide does accompany your group on any hike, he or she is going only as a bystander.
Furthermore, I or we understand that in wilderness areas, possible wilderness dangers are always present, and the hike is at our own risk; we will stay on the maintained trail.
Notice is hereby given: Venturing off the maintained trail or overlooks and/or not paying attention to the trail or where you are hiking may result in injury or death. Overlooks and bridges are extremely dangerous, especially for children, and one should turn back on the hike at the first sign of vertigo (frightened of heights) or nervousness. We understand that My Chauffeur Co. is not responsible for any injuries sustained by any of our group members during any hike. I understand that all children must be accompanied by their parent or legal guardian at all times. The parent or legal guardian agrees to take full responsibility with regards to the safety of their children on any hike.
In addition, our group understands that highways are in the near vicinity of all stops on our tours. We also understand therefore, that care should be taken, especially for children, when near or crossing this highway to get to the viewing areas or hikes, or at any other location on our tour. In addition--riptides and currents along the Oregon coast can be dangerous. Coves backed by steep cliffs should be avoided so you can head for higher ground when the tide changes or if storm-driven winds stir up the sea. We, individually and as a group, release My Chauffeur Company of any and all responsibility for any and all physical or emotional injuries from any hike or for crossing any road.
ALL PASSENGER'S MUST INITIAL THIS DOCUMENT THAT MY CHAUFFEUR HAS INSTRUCTED THEM THAT, DUE TO THE NATURE OF ANY HIKE, THAT IT IS POTENTIALLY DANGEROUS, THAT EACH PASSENGER, WHETHER ADULT OR A CHILD, "HIKES AT THEIR OWN RISK". MY CHAUFFEUR WILL NOT BE RESPONSIBLE FOR ANY PASSENGER THAT INJURES HIS OR HERSELF IN ANY WAY WHILE HIKING OR DURING THE RENTAL PERIOD.
BY SIGNING BELOW, I RELEASE AND FOREVER DISCHARGE MY CHAUFFEUR COMPANY, AFFILIATES AND ADMINISTRATORS AND ASSIGNS FROM ALL MANNER OF ACTIONS, CAUSES OF ACTIONS, DEBTS, ACCOUNTS, BONDS, CONTRACTS, CLAIMS AND DEMANDS FOR OR BY REASON OF ANY DAMAGE, LOSS OR INJURY TO PERSON AND PROPERTY WHICH HAS BEEN OR MAY BE SUSTAINED AS A CONSEQUENCE OF THE FOLLOWING:

All trails pass through areas with sensitive vegetation. Please stay on the trail to protect the vegetation and for safety.
Leave No Trace: Plan Ahead and Prepare: Prepare for extreme weather, hazards and emergencies. Travel on durable surfaces: Use established trails. Dispose of Waste Properly: Pack out all trash, leftover food and litter. Leave What You Find: Avoid introducing or transporting non-native species. - SICKNESS – FINES APPLY for sickness ($2500.00 MAXIMUM FINE) in or on the My Chauffeur vehicle, spills, gum, or damage to windows or emergency exits. - Food: For BYO food; please bring non-messy foods. My Chauffeur charges for food clean-up beyond the normal inside our vehicles. See BELOW, and #11 - Cleaning & Repairs under the service order agreement.
- FOOD SPILLS – FINES APPLY for food spills ($1500.00 MAXIMUM FINE) in or on the My Chauffeur vehicle. ** WHAT CONSTITUTES ‘NORMAL’ CLEAN UP IS THE DECISION OF MY CHAUFFEUR EXCLUSIVELY. AFTER THE COMPLETION OF THE RESERVATION; FEES WILL BE CHARGED (IF APPLICABLE) AS OUTLINED IN THIS RENTAL AGREEMENT; WITH NO NOTICE. WE ALWAYS RECOMMEND CONSUMING FOODS OUTSIDE OF THE VEHICLE, IF POSSIBLE, OR BRING NON-SOFT FOODS WHICH DO NOT MAKE A MESS. Hard alcohol and/or empty hard alcohol bottles found in the vehicle will be subject to an immediate end of your reservation and/or fine in agreement with the contractual agreement (See Terms & Conditions #11). See FOOD & ALCOHOL, PART 1 on your reservation contract. Beer & wine are allowed* but not recommended due to over consumption. Purchased alcohol is requested to be put in the vehicle trunk. Passengers under 21 years of age may not consume alcohol but may be present if alcohol is present as long as they are accompanied by their parent. In the sedan, alcohol is ONLY allowed in the back seat.
